The assumption here is that those intent on committing crimes couldn't get guns via another means. Considering that relatively few criminals get their guns legally, this would generally affect people who are no danger to society in the first place.

A former McKees Rocks policeman will spend 21 months in federal prison for selling a gun that had been confiscated while he was with the department, and then lying about the transaction to FBI agents."

"A Team 4 Investigation last year broke the story of former Sergeant Carl McBane taking the gun from the property room at McKees Rocks Police Department. McBane, 43, was convicted in April on one count of selling a seized rifle in 2001 and another count of lying to federal investigators. McKees Rocks police had taken the rifle in question from a man arrested for public drunkenness."

"In their 1997 lawsuit, the Eslingers had claimed the Troy, Mich.-based Kmart was negligent in selling a 12-gauge shotgun in 1996 to their son, Ryan, who used the firearm the same day to kill his pet dog and then himself."

"The couple said store employees failed to require proper identification and should not have sold a firearm to a mentally ill person. Kmart attorneys responded that the employees did nothing wrong, including accepting a passport for identification."

Are these people really trying to claim that somehow K-Mart employees should have known that the guy was mentally ill? Are they really going to claim that if a driver's license or some other form of identification was presented the staff could have somehow deduced that the man was schizophrenic? Are they really attempting to hold a store liable for the voluntary actions of an adult human being?

Just follow the money, and you'll understand the reason for this absurdity.
