"A guest who was shot eight times in the parking lot of a Roanoke Holiday Inn Express should be allowed to sue the motel for not protecting its customers in a high-crime area, the Virginia Supreme Court has ruled." [emphasis added]

"Ryan Taboada had filed a $3 million lawsuit against the owners of the Holiday Inn Express after being shot and carjacked in the motel's parking lot on Gainsboro Road Northwest in March 2003."

"The case was dismissed last year by Roanoke Circuit Court Judge Clifford Weckstein."

"The case broke new legal ground on the question of what steps a motel owner must take to protect guests from crimes committed on its property." ...

"A few weeks ago the Columbus Dispatch's Glenn Sheller wrote a column Conceal-carry OK, permit secrecy isn't that played both sides of the fence. The author didn't find anything wrong with concealed carry, but he isn't going to get a license. The author is, obviously, opposed to the rights of law-abiding gun owners who want nothing more than to exercise their right to carry a firearm for self-defense without being scrutinized like sexual predators."

"In an effort to set the record straight I wrote a letter to the Columbus Dispatch and despite its length and aggressive approach, it was printed this past Saturday. You can read it here: Gun-owners list used for intimidation" ...

FULL TEXT BELOW:

An appellate court ruled that a father whose teenage son went on a shooting rampage at Santana High School can get back the weapons seized from his home after the 2001 violence.

Two students were killed and 13 were wounded by then-15-year-old Andy Williams, who took a revolver out of his father's locked gun cabinet.

The 4th District Court of Appeal ruled the weapons owned by Charles Jeffrey Williams were not a nuisance, as a trial judge had ruled, because they were not used in the school shooting. Weapons seized at the home included a .22-caliber rifle, a .20-gauge shotgun and an M-16 military bayonet.

Under state law, a court can order a weapon destroyed if it is used in the commission of a crime for which the defendant is convicted.

"An investigation revealed the homeowner saw Vigil trying to break into the front door with the butt end of a rifle. The homeowner grabbed a .410 shotgun and shot the intruder in the chest as he entered the home, but the shot did not stop him, police said."

"The homeowner and his son ran into a back bedroom where the homeowner grabbed a 30-06 rifle and started loading it. Police said the intruder fired two rounds from a 30.30 rifle through the closed bedroom door. He then began to break down the door and was shot in the hip by the homeowner." ...

"Gov. Rod Blagojevich's strategy for getting re-elected is pretty simple: Support emotional, feel-good programs and laws, then dare Republican challenger Judy Baar Topinka to oppose them." ...

"Next Blagojevich renewed his call for a ban on assault rifles, and said Topinka's opposition was a 'shocking and shameful capitulation' to the National Rifle Association and the Illinois State Rifle Association. Never mind that his proposal doesn't stand a chance of passage -- nor is there any evidence it would decrease the crime rate if approved. The federal assault weapon ban expired in 2004, and that hasn't resulted in any increase in crime." ...

"One of the most vigorously debated issues in the Alabama Legislature this session will be back on the agenda Tuesday as the House attempts to give final passage to a bill to expand the instances where a person can kill someone to protect a home or vehicle."

"The Alabama House and Senate have previously passed different versions of the legislation that removes language from current law that says a resident should not use deadly force during a break-in if he or she can 'avoid using force with complete safety.'"

"The legislation ... gives a person who uses deadly force while protecting his home immunity from lawsuits, but it does say a person must feel threatened before using deadly force." ...

"Indiana is now one of only three states with a deadly force law, the other two including Florida and South Dakota. The National Rifle Association says 15 other states are considering similar legislation."

"Governor Daniels signed a law endorsing Indiana resident's right to use deadly force against intruders. The new law says hoosiers do not have to retreat before using deadly force to prevent serious bodily injury to themselves or someone else."

"'It's common sense,' says Governor Daniels. 'It clarified what we already believe the law to be in Indiana now, but there were those who wanted to make certain no just would ever misinterpret that and so as I saw it ...'" ...

FULL TEXT BELOW:

Alaska is a step closer to allowing citizens to use deadly force against muggers, carjackers, sexual assailants and others.

The state Senate today voted 17-to-2 in favor of Senate Bill 200.

The measure expands the state's "castle law" which currently allows a person to use whatever force is necessary to protect their home. The bill allows the use of deadly force outside the home under certain circumstances.

Sponsor and North Pole Republican Gene Therriault says a person must be able to prove they reasonably believed such action was necessary for self defense.

Similar laws have been passed in Florida, Indiana and South Dakota. More than a dozen other states have legislation pending. The bill now goes to the House.

"The fast-moving Florida Legislature takes up one of the most heavily lobbied issues of its 2006 session this week in a showdown between the influential gun lobby and powerful business interests."

"At issue: a bill allowing people to keep weapons locked in their cars at work."

"Associated Industries of Florida and other major retail and corporate lobbying groups staunchly oppose the bill ... Employers historically resist any state mandates, but this one is particularly hot because companies are afraid that an office argument ... might escalate with lethal results, if guns are too handy."

"But Unified Sportsmen of Florida ... has cast the issue as a matter of Second Amendment freedoms. ..." ...

"With a Smith and Wesson held to his head during a random robbery Rick Shindledecker had a clear thought. 'I did not wish I had a gun, I just wished he didnt,' said Shindeldecker, proprietor of Sharkeys Grill in Dewey Beach, who was held at gunpoint for cash a decade ago. Better known as 'Sharky,' he joins legions of people opposing a current bill to loosen restrictions on carrying concealed deadly weapons."

"The New Hampshire House dealt with a flood of bills in the wild sessions leading up to 'crossover day,' when legislation must pass from one chamber to another. This year, it did an unusually good job of moderating the extremes. The Senate, which now has the bills, should not undo the House's thoughtful work." ...

"The House killed a bill that would allow people to use deadly force against anyone who threatens them without first making an attempt to retreat. Under existing law, shooting someone in self-defense instead of retreating if possible is justified only when one is in one's home or its immediate environs." ...

"It's a sign times have changed as today's wives and mothers learn how to lock and load. The National Rifle Association says more women are buying and using guns than ever before -- and we're seeing evidence of that right here in Wisconsin."

"'Back when I was growing up, my mother would never have thought of going hunting,' Janice Keller said, 'and now my husband's constantly telling me I should go hunting with him.'"

"Both hunting and target practice are things Keller and Sherill Kleinhans say they wanted to do. So they, like an increasing number of women, took a civilian training firearms course at Northeast Wisconsin Technical College in Green Bay." ...

"At one area gun club, women are having a blast in their gun club. In fact, thats the name of their club--the Brooks Ladies All-American Shooting Team. They use shotguns to hit clay targets."

"Co-founder Karen Dolan has been in the sport for about 20 years."

"'You don't have to jump high or run fast or have big muscles to shoot. All you have to have is eye-hand coordination,' she said."

"The founders of BLAST had two ideas in mind: to establish a network of women shooters and to introduce new shooters to a safe, fun, and non-intimidating environment." ...

"Starkesia Reed and Siretha White were cut down by stray bullets in sprays of gunfire. Their murders, in recent incidents just days and blocks apart in the Englewood neighborhood of Chicago, were stunning."

"Police say an AK-47 assault rifle converted to automatic use was used in the killing of 14-year-old Starkesia. It is not yet clear what weapon is to blame in the death of 10-year-old Siretha; investigators believe it may have been a pistol equipped with a large ammunition magazine."

"It's an eyesore. Targets, fast food wrappers, beer bottles, aluminum cans, even appliances litter the Rampart Range, a free public shooting range in the Pike National Forest. People bring all their unwanted materials, use them as targets, and leave them at the range for others to fire at or deal with later." ...
