Then the case fell apart.
Now state police have agreed in a settlement to pay $295,000 to Mark Hemstreet, 59, and his longtime friend and political ally Gregg Clapper, 59, of Portland.
State police brought charges against the wrong men, Clapper said Thursday.
"You know how Mark and I got through this?" he said by phone. "The more they did to us, the angrier it made us and the more determined it made us to make these people accountable."
Hemstreet, a conservative and political lightning rod in Oregon politics, was not available for comment. He was credited with helping organize the 1994 Republican takeover of the Oregon Legislature and winning voter approval that year of Measure 8, an attempt to trim state employees |

Last week, the body of Chicago school board president Michael Scott was found in the Chicago River with a single bullet wound in his head. The big story was that this powerful, well-connected public official had, according to the county medical examiner, committed suicide. The less-noticed story was that he did it with an illegal weapon.
After all, handgun ownership is not allowed in the city of Chicago, which has one of the strictest gun control laws in the country, and Scott killed himself with a .380-caliber sidearm.

The Illinois State Rifle Association www.isra.org has issued a warning to its members of a disturbing trend that is a direct threat to gun ownership.
A new law (PA 95-0564) that requires health care providers to report patients to the state police is playing havoc with Illinois gun owners.
The Law was passed by the Illinois General Assembly in a knee jerk response to the Virginia Tech shooting.
The law requires mental health care providers to report patients that are deemed a threat to themselves or society to the Illinois State Police (ISP) but the new law has taken an unexpected twist. |

An armed criminal who tried to rob a bait shop in Bessemer, Alabama was fatally shot in self defense by the store's owner.
Police say that 41 year old Kevin Dudley of Pleasant Grove entered the bait shop, armed with a shotgun, and threatened the lives of those present as part of a robbery attempt. The store owner is said to have grabbed his own gun and shot Dudley in self defense, putting an end to the violent robbery. Dudley reportedly died of his wounds, and none of the robbery victims were harmed. Police also say that Dudley may have committed a homicide and several other robberies, based upon surveillance camera footage and other evidence. |

Earlier this week, I was invited to be Benjamin Rockwells guest on Digital Computer Talk, to record a segment for an episode of his nationally syndicated broadcast radio show (prior episodes here). The subject was smart gun technology and the discussion centered around whether an implementation of that technology could have stopped or minimized the carnage in the Fort Hood terrorist attack or any of the other mass shootings that have taken place in recent years. |

About 25 Ohioans and more than 600 Americans die every year in gun accidents, many in a scenario quite similar to our sad story.
We think parents can take a few simple steps to make these numbers much lower.
First, please keep all guns locked and out of the reach of unsupervised children, including teenagers. There's really no reason for why a child or teen needs access to a gun without supervision. Ammunition also should be locked up separately.
Talk to your children, especially those in homes without guns, about how to handle a situation like we described. Talk to the parents of your friend's children to make sure their home environment is safe in advance. |

As Fox Valley gun deer hunters hit the woods this weekend, some types of ammunition are in short supply.
Meanwhile, in Madison background checks for handguns are running nearly 36 percent above last year, suggesting a big increase in gun sales.
People on both sides of the gun control debate agree on this: People have been stocking up on guns and ammunition since President Barack Obama took office early this year.
"This is definitely a nationwide trend," said Alexa Fritts, a spokeswoman for the National Rifle Association. "We believe the increase in gun sales and the ammunition shortage is a direct result of our current administration." |

Speaking as he toured a school project in Chicago on Nov. 9, Daley said that "unfortunately, America loves guns," and added that "we love guns to a point that we see the devastation on a daily basis," quoted by Fox News.
These comments created a firestorm among gun-rights advocates such as the Citizens Committee for the Right to Keep and Bear Arms.
The organizations chairman Alan Gottlieb accused Daley of trying to use the tragedy to "push his gun prohibition agenda," and "destroy" Second Amendment rights.
"America must ignore the ravings of anti-gun fanatics," he added, "who are so blinded by a hatred for individual liberty and personal protection that they cannot see how foolish and petty they have become." |

Passengers could take guns aboard where checked baggage service is available. That's about 30 percent of Amtrak 520 stations, including Kansas City's Union Station.
The proposal would cover Amtrak's Southwest Chief, which runs from Chicago to Los Angeles through Kansas City.
Consequently, you could transport a gun if you board the Southwest Chief in Kansas City, but not in Lawrence, Topeka or La Plata, Mo., where baggage isn't checked. It wouldn't affect Amtrak service between Kansas City and St. Louis because checked baggage service isn't available on that route, nor can bags be checked in Kansas. |

'The shot just came out of nowhere'
Just as the plaintiffs' previous brushes with police aren't relevant in Alex Clay, Harold Hammick and Richard Booth's lawsuit against the Portland Police, attorney Greg Kafoury probably won't be able to detail Officer Leo Besner's history with firearms to the Multnomah County jury.
But let's review.
In November 2005, a police sniper fatally shot Raymond Gwerder in the back while the guy -- who had threatened to shoot police if they entered his Northeast Portland triplex -- was standing in the backyard, talking on the phone with a police negotiator.
"The shot just came out of nowhere," East Precinct Cmdr. Mike Crebs told investigators. "I thought we were talking to the guy."

Derek S. Snavely, who was accused of raping a woman while on duty as a West Virginia State Police officer last year, is now police chief in Hinton.
A receptionist at the Hinton city building confirmed Snavely was the chief. Calls to Snavely and Mayor Joe Blankenship were not returned.
In an interview with The Charleston Gazette in December 2008, the woman said Snavely told her she was driving in the middle of the road, then performed a field sobriety test on her. She asked him if she was going to get a DUI, and he told her he didn't think she was that drunk. |

A few weeks ago seven of the eight incumbent Democrats in the Virginia House of Delegates who lost their seat to a Republican had one other thing in common - a lower National Rifle Association (NRA) rating that their opponent. . . . Democratic Delegates will soon have a chance to work on their NRA rating. Gun rights organizers widely expect bills to repeal the ban on concealed carry in restaurants serving alcohol as well as to repeal Virginia's nearly unique "one handgun a month" gun purchase rationing law to reach the House floor. Additionally, Democrats . . . will likely get to cast votes on the perennial bill to ban private gun sales at gun shows.
These votes will be watched closely and recorded. Stay tuned.

The video, posted on YouTube, shows an unidentified Bay Area Rapid Transit (BART) officer in a scuffle with a man identified by authorities as Michael Joseph Gibson, 37, of San Leandro, California.
Gibson, who appears disgruntled and gesturing while on a train at the West Oakland station, is pulled off the train by an officer, who has the man in an arm grip.
The officer forcibly walks the man toward the station wall, which is topped by large widows, and one window shatters as the officer appears to force the man against it. |

According to the friends, they along with Panas were walking outside Officer Tepper's home on Elkhart Street and came upon a fight already in progress.
The friends then say that one of them was sucker punched and they then, too, joined in the brawl.
This is when the friends say Officer Tepper came out of his house with a gun.
"He came out with a gun, everybody ran except my son, my son said 'you ain't going to shoot me.' He said 'Oh, no?' Boom," Bill Panas' father, also named Bill, said.
Troy Tortis, one of the friends, told Action News that Tepper began "pointing the gun at everybody."
"He put it to my chest and my face, he put it to another kid's face," Tortis said.
Moments later Panas was shot. |

WILLOWS -- The Willows Unified School District board of trustees has expelled a 16-year-old for having unloaded shotguns in his pickup parked just off the Willows High School campus.
The board voted 4-0 Thursday to expel junior Gary Tudesko after the weapons were discovered via scent-sniffing dogs on Oct. 26. Board Vice President Alex Parisio abstained from the discussion and vote because he is related to Tudesko's family.
..
Geivett said he believed off-campus parking around the school was under the school's jurisdiction, in part because it is primarily used by students. |

A woman, you see, is too weak to whip, let alone murder a man, except with a gun, poison or witchcraft. The use of iron bars to kill is the exclusive privilege of men, or so the thinking goes.
Two days after the Generals death, a 14-year-old girl in Bushenyi allegedly killed one Josephat Mpigika, a 40-year-old man who had tried to rape her. She reportedly killed him with a rock accurately aimed at his head. The police arrested her. Her relatives reportedly refused to stand by her. Her teachers did not bother to check on her. The local council leaders left the matter to the police. The country went about its business as usual. Only FIDA, the Association of Ugandan Women Lawyers, came to her legal rescue.

Worries that Obama Democrats will toughen gun ownership laws, an increase in hunting and fears of recession-driven crime have sent gun sales soaring 30 percent in the first three months of the year, according to Federal Bureau of Investigation (FBI) gun permit statistics.
In September, gun sales rose 12.4 percent, or more than 100,000 new firearms per month. In 2009, gun sales are expected to reach 13.5 million, compared to 12.7 million in the preceding year, FBI monthly estimates said.
"Basically we have a perfect storm in the firearm industry," said Elliott. "We have the most anti-gun president ever in the United States, Obama. And we have a recession going on right now. During economic crises, you know crime goes up." |

What is being called the Second Amendment Sales Tax Holiday will take place Nov. 27-28 to coincide with the unofficial beginning of the Christmas shopping season. The first sale in 2008 was so popular the General Assembly authorized another for 2009.
Annie, get your gun this week and save the sales tax.
Chan Holman, owner of Woodys Pawn & Jewelry in Orangeburg, says last years sales tax holiday was the biggest retail firearms sale ever in the history of our store.
Last year I got here late and the customers were lined up on both sides of the store and the parking lot was full, Holman said. Im even thinking about tearing down a building next to the store (this week) and using it for parking. |

Gun owners in the area could feel the impact of several anti-gun bills that have passed through the Assembly, including the possible ban of .50 caliber firearms.
The summary for Assembly bill 3211A, sponsored by State Assemblywoman Patricia Eddington, outlaws all .50 caliber firearms and larger weapons.
According to the proposed legislation, The .50 caliber weapon is one of the most dangerous weapons in the U.S. militarys arsenal. These weapons are used for long-range tactical assassinations and assaults in the U.S. military.

Crist, most famous for his embrace of President Obama (physically) and Obamas failed stimulus plan (politically) is seen by a growing number of conservatives as too liberal. And not only for that, but for leaning far to the left on global warming. Crists Second Amendment credentials are also in doubt.
The Times and other national press profiling the race for the seat of former Republican Sen. Mel Martinez (who resigned earlier this year) almost always cite the growing unpopularity of the Obama economic agenda as the reason for Rubio on the rise and Crists decline. |
